CBD is legal but tightly regulated in Austria. Since the 2025 retail reforms, CBD oils, hemp flower below 0.3 percent THC, and related products may be sold only through licensed tobacconists (Trafiken) and are subject to tobacco taxation. The Federal Ministry of Finance administers the monopoly framework, and the Federal Ministry of Social Affairs, Health, Care and Consumer Protection (BMSGPK) oversees consumer-protection aspects.
Food products and dietary supplements containing CBD remain outside the EU Novel Food authorization list, so direct ingestible CBD sales as supplements are restricted. Cosmetic CBD is permitted under EU cosmetic rules. Pharmaceutical CBD such as Epidyolex is registered through AGES and prescribed for treatment-resistant epilepsy. Any product exceeding 0.3 percent THC falls under SMG and is treated as cannabis.
Online sales by non-tobacconists have narrowed sharply since the 2025 changes, and customs intercepts non-compliant imports.
