Is Marijuana Legal in Puerto Rico?

Recreational cannabis is illegal in Puerto Rico; medical cannabis is legal. Puerto Rico legalized medical cannabis in 2015 and codified the program under Law 42-2017, with the Departamento de Salud (Department of Health) licensing dispensaries for patients with qualifying conditions. Adult recreational use, sale, and home cultivation remain prohibited — several legalization bills have been introduced over the years, but none have advanced to a vote as of 2026.

Registered patients may purchase up to a 30-day supply from licensed dispensaries, with a daily allowance of roughly 1 ounce (28 g) of flower or 8 g of THC in concentrate or edible form. Smoking (combustion) of cannabis flower is banned; vaporization is permitted only by exception for terminal illness or where no adequate alternative treatment exists. Puerto Rico recognizes valid out-of-state medical cards and issues temporary tourist cards, so visiting patients can access dispensaries. Hemp-derived CBD products containing no more than 0.3% delta-9 THC are legal under federal law and widely available.
