Brazilian courts have repeatedly held that importing or possessing small quantities of cannabis seeds is not a crime under Law 11,343/2006 because seeds contain no THC, though there is still no licensed retail seed market. In November 2024 the Superior Court of Justice (STJ) authorized industrial hemp below 0.3% THC for medical and pharmaceutical purposes and ordered ANVISA to regulate, and ANVISA resolutions published in early 2026 (RDC 1,011-1,015) authorize licensed import of seeds and seedlings. Unauthorized germination for drug purposes remains prosecutable.
