The Supreme Court's Declaratoria General de Inconstitucionalidad 1/2018 (28 June 2021) struck down the absolute ban on adult personal cannabis use and cultivation in the Ley General de Salud, and COFEPRIS was expected to authorize self-cultivation, including seed acquisition. COFEPRIS has never issued implementing guidelines, so applicants still rely on amparo litigation and there is no regulated way to buy, sell or gift viable seeds; unauthorized commerce remains prosecutable under the Ley General de Salud and Federal Criminal Code. Mexico also lacks an operating industrial hemp licensing framework, leaving low-THC seed unregulated as well.
