Act 42-2017 (the MEDICINAL Act) authorizes a licensed medical cannabis industry in Puerto Rico, and its definition of medical cannabis expressly covers seeds, so viable seed may be produced, sold and transferred only among licensed cultivators and establishments regulated by the Medicinal Cannabis Regulatory Board. Patients may not grow at home, so individuals have no lawful route to buy, receive or gift viable marijuana seeds. Hemp seed of varieties at or below 0.3% THC is handled under Puerto Rico's USDA-approved hemp plan administered by the Department of Agriculture, with grower licensing required.
