Common questions

Is marijuana legal in Canada?

Canada legalized non-medical cannabis on October 17, 2018, when the Cannabis Act (Bill C-45, S.C. 2018, c. 16) came into force.

Is CBD legal in Canada?

CBD is federally regulated as cannabis in Canada. Under Section 1 of the Cannabis Act and Schedule 1 of the same Act, cannabidiol is a controlled substance regardless of THC content or whether it is derived from hemp or marijuana.

Is hemp legal in Canada?

Industrial hemp has been legal in Canada since 1998 and is now regulated under the Industrial Hemp Regulations (SOR/2018-145), issued under the authority of the Cannabis Act.

Can you travel to Canada with cannabis or CBD?

Import and export of cannabis for non-medical or non-scientific purposes is prohibited under Section 11 of the Cannabis Act. CBD import and export follows the same regime as cannabis.

The Cannabis Act (S.C. 2018, c. 16) lets adults buy viable cannabis seeds from provincially or territorially licensed retailers, possess the public equivalent of 30 grams — one seed being deemed equivalent to one gram, i.e. 30 seeds — and gift within that limit. Up to four plants may be grown per household, except where Quebec and Manitoba restrict home cultivation. Industrial hemp requires a licence under the Industrial Hemp Regulations (SOR/2018-145), and commercial growers must plant pedigreed seed of cultivars on Health Canada's annual List of Approved Cultivars.
