Spanish law does not schedule cannabis seeds as narcotics, and since the early 2000s Spanish seed banks have lawfully marketed viable seeds as collectors' items, while cultivation for personal use in private, non-visible spaces is tolerated, with public possession and consumption sanctioned administratively under Organic Law 4/2015. Cultivation or supply oriented to trafficking remains a crime under Article 368 of the Criminal Code. Industrial hemp must be grown from certified seed of varieties in the EU common catalogue, per Royal Decree 1729/1999, and only for fibre, grain or seed production.
