New Jersey Hemp & THCA Ban 2026: What's Banned, What's Still Legal & What Comes Next

Last Updated: April 2026

New Jersey's hemp market changed fundamentally on January 12, 2026, when Governor Phil Murphy signed S4509 (P.L.2025, c.215) into law. If you're a New Jersey hemp retailer and you're reading this in April 2026, the deadline for non-compliant inventory liquidation was April 13, 2026.

What New Jersey Banned and When (2026 Update)

The Emergency Intoxicating Hemp Law

S4509 rewrites New Jersey's definition of "hemp" to align with new federal hemp standards. The core change: hemp is now defined as cannabis containing no more than 0.3% total THC — not just delta-9 THC, but all THC isomers and analogs, including THCA post-decarboxylation. Governor Murphy signed the bill January 12, 2026. Several provisions took effect immediately (January 13, 2026): immediate ban on selling synthesized cannabinoids (delta 8 produced from CBD, HHC, etc.), immediate ban on online sales of any hemp-derived product, and immediate ban on sales of any hemp product to persons under 21. The new hemp definitions — and the retail ban on most intoxicating hemp products — took effect April 13, 2026.

What Products Are Now Illegal to Sell in NJ

After April 13, 2026, the following are prohibited outside the licensed cannabis market:

  • THCA flower and any hemp product with more than 0.3% total THC
  • Delta 8 gummies, vapes, tinctures, and flower
  • Delta 10 products
  • HHC and all other synthetically derived cannabinoids
  • Any hemp edible with more than 0.4mg total THC per container
  • THCP and all other potent cannabinoid analogs

Is THCA Legal in New Jersey?

After April 13, 2026: No, not outside the licensed cannabis market. S4509 explicitly reclassifies THCA as part of the total THC calculation. A hemp plant or product that, when heated, would produce more than 0.3% total THC is classified as cannabis (marijuana) under New Jersey law and can only be sold by licensed cannabis retailers under the New Jersey Cannabis Regulatory Commission (CRC).

CBD Products Still Allowed

CBD oil, tinctures, topicals, and capsules that contain no detectable THC (or trace amounts well below 0.4mg total per container) remain legal as hemp products. Note: online sales of non-intoxicating hemp products are also prohibited under S4509's immediate provisions — which is an unusual restriction that covers even compliant CBD products sold online within New Jersey.

Hemp Beverages — Lingering Exception

S4509 created a temporary beverage carve-out: through April 12, 2026, intoxicating hemp beverages could be sold by any retailer. April 13 through November 13, 2026: only ABC-licensed retailers can sell hemp beverages with up to 5mg THC per serving and 10mg THC per container. After November 13, 2026: only CRC-licensed cannabis retailers can sell THC beverages.

NJ Hemp Retailers — What to Do Right Now

If you're a New Jersey hemp retailer reading this in April 2026:

  1. Immediately stop selling delta 8, THCA flower, HHC, and any product with more than 0.4mg total THC per container
  2. Cease online sales of hemp products to NJ consumers (the online sales ban was immediate)
  3. Clear non-compliant inventory — the liquidation window closed April 13
  4. Evaluate CRC licensing if you want to continue in the THC product business
  5. Pivot to compliant CBD — non-intoxicating CBD products with full panel COAs remain a viable business
