CBD is legal in Costa Rica. Law 10113 and its implementing regulation, Executive Decree 43706-MAG-S, explicitly authorize the production, importation, and sale of CBD products derived from industrial hemp containing no more than 1% THC by dry weight.
CBD products sold commercially must be registered with the Ministerio de Salud as either food supplements, cosmetics, or natural medicines, depending on their formulation and claims. Unregistered products are subject to seizure and the seller to administrative fines. Retail sale through pharmacies, health stores, and online retailers has expanded significantly since 2023, with both domestically produced and imported brands available.
Possession and personal use of CBD products carry no criminal or civil penalties for consumers, provided the products comply with the 1% THC cap and are properly registered for commercial sale.

Import and export of CBD products is permitted with a sanitary registration from the Ministerio de Salud. Importers must demonstrate that products meet the 1% THC threshold through certificates of analysis from accredited laboratories. Personal importation of unregistered CBD products through mail or courier is technically prohibited but enforcement at customs is inconsistent for small personal quantities.
