Recreational cannabis is illegal in Croatia. The Act on the Suppression of Drug Abuse (Zakon o suzbijanju zlouporabe droga, NN 107/01 with subsequent amendments) classifies cannabis, cannabis resin, and THC as controlled narcotic substances. Possession for personal use is treated as a misdemeanour under Article 54 of the Act, carrying fines from 700 to 2,650 EUR. Production, sale, and trafficking are criminal offences under Article 190 of the Criminal Code (Kazneni zakon), with penalties ranging from six months to twelve years imprisonment depending on quantity and aggravating circumstances.
Medical cannabis became accessible in October 2015 after the Ministry of Health amended the controlled substances list and adopted the Ordinance on the Conditions for Prescribing and Dispensing Medicines Containing THC. Patients with cancer, multiple sclerosis, epilepsy, AIDS, and certain other indications can receive cannabis-based preparations on prescription, dispensed through pharmacies. The Agency for Medicinal Products and Medical Devices (HALMED) authorises specific products, and prescriptions are limited to 7.5 grams of THC per month. Sativex is registered; magistral preparations are also permitted. Home cultivation remains prohibited regardless of medical status.

Import and export of cannabis for medical or scientific purposes require authorisation from the Ministry of Health and HALMED in line with the 1961 Single Convention on Narcotic Drugs. Each shipment needs an individual import or export licence, with the International Narcotics Control Board notified through the standard estimates and statistics regime. Commercial recreational trade is prohibited and prosecuted as trafficking under the Criminal Code.
