Industrial hemp cultivation has been legal in Denmark since 1998 and is regulated by Landbrugsstyrelsen (the Danish Agricultural Agency) under the Ministry of Food, Agriculture and Fisheries. Growers must register, plant only EU-certified Cannabis sativa L. varieties listed in the EU Common Catalogue of Varieties of Agricultural Plant Species, and stay at or below 0.3% THC in the field (raised from 0.2% by Regulation (EU) 2021/2115 effective 1 January 2023). Hemp seeds and hemp fibre in isolated form are explicitly carved out of List A under the Act on Euphoriant Substances.
Cultivation supports approved end uses: fibre, seed for food and feed, and seed oil. Cannabinoid extraction from the flowering tops is not authorised under the agricultural hemp licence and falls back under the Act on Euphoriant Substances. Hemp food products such as hulled hemp seeds, hempseed oil, and hemp flour are not novel foods and may be sold under standard Fødevarestyrelsen rules, but hemp leaf, flower, and CBD extracts remain restricted.

Hemp seed and fibre move freely within the EU single market under Regulation (EU) 2021/2115 and customs nomenclature codes CN 1207 99 (hempseed) and CN 5302 (hemp fibre). Imports of viable hemp seed for sowing require an EU-certified variety listed in the Common Catalogue and import notification to Landbrugsstyrelsen. Hemp flower, leaf material, and cannabinoid-rich biomass are not covered by the agricultural exemption and require Lægemiddelstyrelsen authorisation as a controlled cannabis product.
