Recreational marijuana is decriminalized in Dominica for personal-use quantities. The Drugs (Prevention of Misuse) (Amendment) Act, Act No. 8 of 2020, amended the principal Drugs (Prevention of Misuse) Act Chapter 40:07 to remove criminal penalties for possession of up to 28 grams (one ounce) of cannabis and to allow cultivation of up to three plants per adult household for personal use.
Possession at or below the threshold is a non-arrestable infraction; the Commonwealth of Dominica Police Force may confiscate the cannabis but cannot create a criminal record. Possession above 28 grams remains a criminal offense triable in the Magistrate's Court at Roseau, with fines up to EC$10,000 or 1 year imprisonment, and trafficking carries up to 25 years on indictment. Public consumption remains prohibited, and the Ministry of National Security has signaled enforcement at Douglas-Charles Airport (Marigot) and Cruise Ship Berth arrivals. Rastafarian sacramental use receives narrow accommodation under the 2020 amendment.
