Recreational marijuana is illegal in Estonia. The Narcotic Drugs and Psychotropic Substances and Precursors Act (Narkootiliste ja psuhhotroopsete ainete ning nende lahteainete seadus) classifies cannabis as a Schedule I narcotic, and possession of any amount triggers misdemeanor liability under Section 151.
Possession of small quantities, defined as up to 7.5 grams of herbal cannabis, is a misdemeanor punishable by a fine of up to EUR 1,200 or detention up to thirty days. Larger quantities, sale, manufacture, or trafficking become criminal offenses under Penal Code Section 184, carrying one to ten years in prison; aggravated trafficking can reach fifteen years. The Police and Border Guard Board (PPA) enforces, the Prosecutor's Office (Riigiprokuratuur) charges, and the Ministry of Social Affairs sets drug policy.
Cultivation of even one plant is criminal regardless of intent. Driving with any detectable THC results in a EUR 400 fine and license suspension under the Traffic Act.
