Georgia decriminalized personal cannabis consumption following two landmark Constitutional Court rulings (Decision N1/3/1282 of July 30, 2018 and earlier Decision N1/13/732 of November 2017). The court struck down imprisonment for personal use as a disproportionate restriction on free development of personality under Article 16 of the Georgian Constitution. Cultivation, sale, transport, and public consumption remain criminal under the Code on Administrative Offences and the Criminal Code of Georgia. The Ministry of Internal Affairs and the Special Penitentiary Service oversee enforcement.
Adult possession and consumption of marijuana in private are not prosecuted, but there is no legal commercial market. Selling cannabis carries 6 to 12 years' imprisonment under Criminal Code Article 260, and consumption in the presence of minors or in public spaces still draws administrative fines starting at 500 GEL. Driving under the influence triggers license suspension and fines up to 3,000 GEL. No medical cannabis program has been established, and pharmacy access is limited to imported registered pharmaceuticals approved case by case.

Cannabis import and export are prohibited. The Revenue Service of Georgia and the Border Police, under the Ministry of Internal Affairs, intercept cannabis at land borders and Tbilisi International Airport. Personal-use decriminalization does not extend to border crossings, where customs treats any quantity as smuggling.
