CBD in Guatemala occupies a grey zone and is treated as restricted under Decree 48-92 and the country's pharmaceutical regulations administered by the Departamento de Regulación y Control de Productos Farmacéuticos y Afines. No statutory THC threshold separates hemp-derived CBD from marijuana, so CBD products are generally treated as controlled substances unless registered as medicines.
The Ministerio de Salud Pública y Asistencia Social may authorise specific pharmaceutical CBD products on a case-by-case basis under the Código de Salud (Decree 90-97). Imported consumer CBD oils and supplements are not formally registered for sale, and customs enforcement has been inconsistent. Pharmacies and wellness retailers occasionally stock imported CBD products, but the legal status of those sales remains ambiguous and subject to regulatory action.
