Industrial hemp is legal in Luxembourg when grown from EU-certified seed varieties listed in the Common Catalogue with THC content at or below 0.3%. The Ministry of Agriculture, Viticulture and Rural Development administers registration through the Service d'Economie Rurale (SER).
Farmers register hemp plots and submit seed certificates to qualify for Common Agricultural Policy direct payments under Regulation (EU) 2021/2115. Cultivation is small-scale, with under 100 hectares annually, mainly for seed, fiber, and food applications. Flower-derived cannabinoid extraction remains a gray area, and operators face Direction de la Sante oversight when products carry medicinal claims.
Crops testing above 0.3% THC must be destroyed under SER supervision, and the grower forfeits CAP payments. The 2023 personal-cultivation reform did not change industrial hemp rules.
