Recreational marijuana is decriminalized in Luxembourg under the Law of 19 July 2023 amending the Law of 19 February 1973 on the sale of substances having a poisonous or narcotic effect. Adults aged 18 and over may cultivate up to four cannabis plants per household for personal consumption and possess up to three grams in public without facing criminal prosecution.
Home-grown cannabis must be invisible from public view, and sale, advertising, and consumption in front of minors remain criminal. Public consumption is prohibited and subject to a EUR 25 to EUR 500 administrative fine, increased from earlier ranges when the 2023 reform passed. Possession exceeding three grams remains a misdemeanor, and amounts above large thresholds trigger criminal charges under Article 7 of the 1973 law with prison up to two years.
The Police Grand-Ducale and the Public Prosecutor's Office (Parquet) enforce, while the Ministry of Health and the Ministry of Justice administer the policy. A regulated commercial market remains under study but has not been authorized.

Import and export of marijuana remain prohibited under the 1973 law as amended. Cross-border movement, including from neighboring Belgium, France, and Germany, triggers customs and police action. Personal-use possession reforms do not authorize cross-border carriage, which is treated as trafficking.
