Cannabis & Hemp Overview

Recreational marijuana is illegal in Malaysia and the country runs one of the harshest cannabis regimes in Asia. The Dangerous Drugs Act 1952 lists cannabis as a Class I substance, and the mandatory death penalty for trafficking was only abolished in April 2023 under the Abolition of Mandatory Death Penalty Act 2023. Judges retain discretion to impose death or life imprisonment.

Possession of any amount can trigger up to five years in prison and a fine of up to RM 20,000. Trafficking is presumed at 200 grams of cannabis or 50 grams of resin under Section 37(da), and conviction carries the death penalty or life imprisonment plus a minimum of 12 strokes of the cane. Cultivation of a single plant brings a mandatory minimum of three years and six strokes. The Royal Malaysia Police and the National Anti-Drugs Agency (AADK) enforce the law, and the Attorney General's Chambers prosecutes. Foreigners receive no leniency, and consular access does not affect sentencing.

A limited medical pathway exists but recreational use, sale, and home growing remain criminal offenses with severe consequences.
