CBD is legal in Mexico when derived from cannabis containing 1% THC or less and used in products with wide industrial application. Article 245, section V of the Ley General de Salud expressly permits commercialization, import and export of cannabis derivatives at or below 1% THC for cosmetics, food supplements, personal care products and other industrial uses.
Higher-potency CBD intended as a medicine requires a COFEPRIS sanitary registration (registro sanitario) as a medicamento herbolario or specialty drug, plus a prescription if classified as a controlled medication. CBD cosmetics and food supplements must obtain a notice of operation (aviso de funcionamiento) and a product notice; advertising must comply with the Reglamento de la Ley General de Salud en Materia de Publicidad.
The 11 June 2025 COFEPRIS modernization agreement tightened documentation requirements (mandatory PDF/A digitally signed e-filings, foreign approval evidence, GMP audits) for CBD importers. A 2025-2026 customs/tariff reform proposes higher duties and stricter controls on chemicals, botanicals and nutraceuticals including CBD.

Import of CBD products requires a COFEPRIS sanitary permit and proof that the source material contains 1% THC or less. Importers must file through the modernized e-filing portal, present a Certificate of Analysis from an accredited laboratory, foreign regulatory approvals where available, and a registro sanitario for finished products marketed as medicines, supplements or cosmetics. The Tax Administration Service (SAT) coordinates customs clearance and HS classification. Export is permitted under equivalent COFEPRIS authorization. Personal importation by travelers is not permitted without prior authorization.
