CBD in Peru falls under the same Law 30681 framework as medical cannabis. There is no separate legal carve-out for low-THC or hemp-derived CBD — every cannabidiol product sold as a therapeutic preparation must hold a sanitary registration from DIGEMID, regardless of THC content. Supreme Decree 005-2019-SA sets the manufacturing, labeling, and dispensing rules, and registered products move through licensed pharmacies and pharmaceutical establishments only.
CBD is not sold over the counter as a general wellness supplement. DIGESA, which oversees food and dietary supplements, does not currently recognize CBD as an authorized food ingredient, so cosmetics, gummies, and beverages marketed with CBD claims operate without sanitary backing and face seizure by INDECOPI or DIGEMID inspectors. Patient associations historically produced artisanal CBD oils before the 2017 law, and Law 30681 included a transitional path for these groups, but commercial-scale unregistered sale of CBD is treated as the unauthorized sale of a pharmaceutical product. Penalties include product confiscation, administrative fines, and potential criminal exposure under Article 296 if the product contains THC above trace levels.

CBD imports require DIGEMID sanitary registration of the specific product plus a per-shipment import permit. Bulk CBD isolate or distillate imported for manufacturing requires the importer to hold a pharmaceutical input license. Certificates of analysis showing cannabinoid profile and absence of contaminants must accompany every shipment. Personal mail-order imports of CBD oils are not authorized and are routinely seized by SUNAT customs.
