Peru does not yet have a fully operational industrial hemp regime distinct from its medical cannabis framework. Law 30681 and Supreme Decree 005-2019-SA reference cannabis for medical and scientific purposes but do not establish a separate low-THC industrial hemp category with the 0.3 percent or 1.0 percent THC thresholds used in North America and parts of Europe. MINAGRI (the Ministry of Agrarian Development and Irrigation) has been developing implementing rules for non-psychoactive cannabis cultivation, and several draft regulations circulated in 2023 and 2024 to authorize hemp for fiber, seed, and grain under agricultural licensing.

In practical terms, cultivation of any Cannabis sativa plant currently requires authorization tied to the medical regime — there is no automatic agricultural permit for hemp farmers. Producers interested in fiber or seed crops must coordinate with DIGEMID and MINAGRI on a case-by-case basis, and several pilot projects have operated under research permits issued through SENASA and INIA. Industry associations have lobbied for a dedicated industrial hemp law, but as of 2026 that legislation has not been enacted. Hemp-derived food products, textiles, and construction materials may be imported under standard customs rules provided they contain no detectable THC.

Import Export Rules for the Country

Finished hemp products such as hempseed food, protein powder, textiles, and construction materials may be imported through standard SUNAT customs procedures and SENASA phytosanitary clearance for food items. Hemp seed for planting requires INIA authorization and falls under the cannabis cultivation controls administered through DIGEMID and MINAGRI coordination. Bulk hemp biomass, CBD-rich hemp extract, and hemp flower are treated as cannabis under Law 30681 and require pharmaceutical-channel registration regardless of THC content.
