CBD is legal to sell in Poland when it is derived from industrial hemp and contains no more than 0.3% THC, the limit set under the 2022 amendment to the Drug Prevention Act. Pure CBD itself is not listed as a narcotic in the Annexes to the Drug Prevention Act, so isolates and full-spectrum extracts can move through retail channels provided they comply with EU food, cosmetic, and pharmaceutical rules.
The catch sits at the food layer. The European Commission's Novel Food Catalogue lists CBD extracts and isolated cannabinoids as novel foods under Regulation (EU) 2015/2283, which means any ingestible product needs pre-market authorisation. Poland's Główny Inspektorat Sanitarny (Sanepid) has used this position to challenge oils, gummies, and beverages sold as supplements, and several distributors have faced product seizures since 2023. CBD cosmetics fall under Regulation (EC) No 1223/2009 and are tolerated when notified through the CPNP. CBD-based medicinal products require URPL authorisation; Epidyolex is registered for specific epilepsy indications.
