Industrial hemp is legal to grow in Poland. Farmers must register with the Krajowy Ośrodek Wsparcia Rolnictwa (KOWR) and use seeds from varieties listed in the EU Common Catalogue of Varieties of Agricultural Plant Species. The 2022 amendment to the Drug Prevention Act raised the THC threshold for industrial hemp from 0.2% to 0.3% delta-9 THC, aligning Poland with the Common Agricultural Policy reform under Regulation (EU) 2021/2115.
Cultivators submit an annual declaration to KOWR listing the field location, variety, and intended end use, which can be fibre, seed, food, cosmetics, or extraction feedstock. KOWR carries out field inspections and takes samples in accordance with Commission Delegated Regulation (EU) 2022/126. Hemp grown without registration is treated as illegal cannabis cultivation under Article 63 of the Drug Prevention Act, with penalties of up to three years' imprisonment. Downstream processing of hemp into food, feed, cosmetics, or building materials is permitted. Hemp seed, hemp seed oil, and hemp protein are not classed as novel and can be sold without pre-market authorisation.

Hemp seed and finished hemp products move freely within the EU single market under free-movement rules, with no separate permit required from KOWR. Imports of certified hemp seed from non-EU countries need phytosanitary certification and must be drawn from EU-listed varieties to qualify as legal industrial hemp. Exports of hemp biomass for extraction face the same novel food and pharmaceutical scrutiny as the destination state applies. Cross-border movement of high-THC chemovars outside the 0.3% limit is prosecuted as a controlled drug offence under Article 55 of the Drug Prevention Act.
