CBD is legal in Puerto Rico when derived from hemp containing no more than 0.3% delta-9 THC, consistent with the federal 2018 Farm Bill that applies to Puerto Rico as a U.S. territory. Hemp-derived CBD topicals, cosmetics, and smokable flower are sold openly in pharmacies, wellness shops, and tourist areas across San Juan, Ponce, and Mayaguez without a prescription.
CBD ingestibles (tinctures, gummies, beverages, capsules) occupy the same federal gray zone as on the U.S. mainland - the FDA has not approved CBD as a dietary supplement or food additive, and FDA warning letters apply in PR. Enforcement is light but possible, especially for products making medical claims. Only Epidiolex (FDA-approved CBD prescription) is formally recognized as a medicine. Higher-potency CBD products (greater than 0.3% THC) are restricted to Puerto Rico's medical cannabis program under Law 42-2017, requiring a registered patient card. As of 2026, no recreational adult-use CBD retail framework exists, but personal possession of small quantities is decriminalized.

Hemp-derived CBD under 0.3% delta-9 THC can be shipped between Puerto Rico and the U.S. mainland via USPS, FedEx, and UPS under the 2018 Farm Bill, as PR is part of the U.S. customs territory. International imports require FDA clearance and USDA documentation. Medical-grade CBD (greater than 0.3% THC) cannot cross territorial borders, even to other U.S. states with legal programs - federal Controlled Substances Act still applies.
