Industrial hemp is legal in Serbia when cultivated from EU-certified seed varieties with THC content at or below 0.3%. The Ministry of Agriculture, Forestry and Water Management, through the Plant Protection Administration, licenses growers, conducts plot inspections, and approves seed varieties.
Farmers must obtain prior cultivation permits, register plots with the Ministry, submit seed certificates, and accept random THC sampling. Serbia is a regional hemp producer with several thousand hectares dedicated to seed and fiber. The Provincial Secretariat for Agriculture in Vojvodina supports research and limited extraction trials, but flower-derived cannabinoid production triggers ALIMS pharmaceutical oversight.
Crops testing above 0.3% THC must be destroyed and the grower may forfeit eligibility for future permits. Operating without a permit is a misdemeanor under the Law on Plant Health and may escalate to narcotic offenses under the Criminal Code.
