Recreational marijuana is illegal in Seychelles. The Misuse of Drugs Act 2016 (Act 5 of 2016) repealed the 1990 statute and reclassified cannabis as a Class B drug under Schedule 1.
Section 7 punishes possession of up to 25 grams of cannabis flower or 5 grams of cannabis resin as a summary offence with a fine of up to 50,000 rupees and imprisonment for up to 5 years, but practice treats first-time small-quantity possession with diversion to the Agency for the Prevention of Drug Abuse and Rehabilitation (APDAR). Trafficking under Sections 5 and 6, including a presumption above 25 grams, carries imprisonment for life and fines up to 750,000 rupees. The Anti-Narcotics Bureau (ANB) leads enforcement and the Supreme Court adjudicates trafficking cases. A 2017 amendment opened limited diversion for users; the 2022 Drug Master Plan still bars cultivation and supply.
