Recreational marijuana is illegal in Slovakia and the country runs one of the harsher cannabis regimes in the EU. The Act on Narcotic Drugs, Psychotropic Substances and Preparations (Act No. 139/1998 Coll.) lists cannabis as a Schedule I substance, and the Criminal Code (Trestny zakon) Section 171 criminalizes possession for personal use.
Possession of even small quantities for personal use is a criminal offense under Section 171, with sentences from six months up to three years; aggravated cases reach five years. Sale, production, and trafficking fall under Section 172, carrying four to ten years; particularly large quantities trigger ten to fifteen years and aggravated forms up to twenty-five years. Slovakia treats first-time small-quantity possession less leniently than most EU peers and explicit possession-of-one-joint convictions are common.
The Police Force (Policajny zbor) and the Prosecutor General's Office enforce, while the Ministry of Health sets policy. In 2023, the parliament approved a framework permitting cannabidiol-rich medical cannabis preparations, but recreational possession remains squarely criminal.
