Industrial hemp cultivation is legal and regulated in Spain under EU Common Agricultural Policy (CAP) frameworks, making Spain one of the largest hemp producers in Europe. Farmers must register with the Ministerio de Agricultura, Pesca y Alimentacion (MAPA) and cultivate only EU-approved certified seed varieties listed in the Common Catalogue. The THC limit for field cultivation was raised from 0.2% to 0.3% effective January 1, 2023 under Regulation (EU) 2021/2115. Permitted end-uses include fiber, hurds, seed, seed oil, animal feed, textiles, construction materials (hempcrete), and bioplastics. Hemp seed and seed oil are authorized foods under EU rules; however, hemp flower, leaves, and extracts intended for human consumption remain restricted under Novel Food regulations. Cultivation for CBD extraction requires additional AEMPS authorization. Unauthorized cultivation triggers narcotics enforcement under the Penal Code.

Imports from third countries require documentation proving THC content below 0.3% and compliance with EU phytosanitary standards. Spain exports significant volumes of hemp fiber, seed, and CBD raw material to France, Germany, Italy, and non-EU markets.
