Industrial hemp cultivation is legal in Sweden but tightly restricted. Farmers may grow only EU-certified Cannabis sativa L. varieties listed in the EU Common Catalogue with a THC content not exceeding 0.3%, and must register their fields with Jordbruksverket (the Swedish Board of Agriculture) to claim CAP support payments. However, Sweden takes a uniquely strict view of downstream hemp products: the Supreme Court (Hogsta domstolen) ruled in NJA 2019 s. 531 and reaffirmed in subsequent 2023 case law that hemp flowers and unprocessed hemp containing any THC are classified as narcotics under the Narcotic Drugs Criminal Act, regardless of the 0.3% field-level threshold. This means hemp tea, smokable hemp flower, and similar products that are legal elsewhere in the EU can be prosecuted as drug offenses in Sweden, with the same penalty scale as cannabis (day-fines from roughly SEK 1,500 for minor offenses, up to 3 years imprisonment for ordinary offenses). Hemp fiber, seeds (dehulled or whole), and hemp seed oil with no measurable THC are permitted as food and industrial inputs, and Livsmedelsverket (the Food Agency) enforces EU novel food rules on hemp-derived ingredients.
