High-THC cannabis (>=1% THC) remains a controlled narcotic under the Federal Narcotics Act (Betaubungsmittelgesetz, BetmG, SR 812.121). Adult possession of up to 10 grams for personal use is decriminalized under Article 19b BetmG: police issue a CHF 100 fixed fine with no criminal record, though cultivation, sale, and possession above 10g remain criminal offenses.

Medical cannabis access was significantly liberalized on 1 August 2022 when amendments to the BetmG removed the requirement for a Federal Office of Public Health (FOPH) special authorization. Physicians may now prescribe cannabis-based medicines (including dronabinol, Sativex, and magistral preparations) directly, with Swissmedic regulating product quality. Health insurance reimbursement remains case-by-case.

Recreational pilot trials operate under Article 8a BetmG and the Pilot Trials Ordinance (BetmPV) of 15 September 2021. As of 2026, regulated adult-use studies (Weed Care Basel, Zuri Can Zurich, Cann-L Lausanne, Grashaus Projects Bern, and Geneva's pilot) supply Swiss-grown organic cannabis through pharmacies and social clubs to enrolled residents. Federal Parliament continues debating Felix Wettstein's draft bill for full legal regulation, but no nationwide legalization law has passed.
