Code Ann. § 39-17-402 includes viable seeds in the marijuana definition (only sterilized seeds are excepted), so sale, purchase, or gratuitous transfer of marijuana seeds is chargeable under §§ 39-17-417/-418. Hemp cultivation remains lawful only under a Tennessee Department of Agriculture producer license (§ 43-27-101 et seq.), while HB 1376 (2025) moved hemp-derived cannabinoid product regulation to the Alcoholic Beverage Commission under new Title 57, ch. 7, with the framework taking full effect July 1, 2026 — a products regime that does not create any pathway for marijuana seed commerce. Seeds testing ≤0.3% THC arguably meet the hemp definition, but Tennessee has issued no guidance endorsing that reading for propagative marijuana genetics.
