Kentucky Hemp Overview

HB 544, signed by Governor Beshear on March 23, 2023, was the law that pulled delta-8 and other intoxicating hemp cannabinoids under CHFS oversight. Implementing rules took effect August 1, 2023 and have been updated through 2025. Delta-10 THC is governed by the same three rules that govern delta-8 and hemp delta-9 in Kentucky. First, 302 KAR 50:070 bans the retail sale of raw hemp flower and prerolls, which captures delta-10 flower regardless of cannabinoid percentage. Second, 902 KAR 45:190 requires child-resistant packaging where applicable, cannabinoid identification at the same font size as the product name, scannable QR-coded warning statements, and a ban on candy or cartoon imagery. Third, every retail SKU must be listed on the CHFS Approved Product Registry, with a per-batch certificate of analysis from an ISO 17025 accredited lab and the state total-THC math: Total THC = delta-9 THC + (THCA x 0.877) at or below 0.3 percent on a dry-weight basis.

The post-decarboxylation formula in Kentucky measures delta-9 and THCA. Delta-10 itself is not weighted in the calculation, but delta-10 SKUs typically contain residual delta-9 and THCA from the conversion process. Those residuals are what the registry test catches.

Enforcement focus tracks the patterns documented across other intoxicating hemp cannabinoids: unregistered SKUs on convenience-store and vape-shop shelves, packaging that mimics candy or character brands, and sales to customers under 21.
