The Narcotics Control Commission Act, 2020 (Act 1019) s.45 criminalises the sale, purchase, possession or use of cannabis without lawful authority, and seeds are treated within this prohibition; unlicensed supply, even without payment, carries a minimum five-year sentence. After the Supreme Court struck down s.43 in 2022, Parliament re-enacted it via the 2023 amendment (Act 1100), and LI 2475 (2023) now regulates cultivation of cannabis not exceeding 0.3% THC. The state does not supply seeds: NACOC-licensed operators may import approved hemp seed varieties under strict supervision, and Ghana launched its regulated medicinal/industrial cannabis programme in early 2026. There is no lawful retail channel for viable seeds for the general public.
