Uniquely, the Dangerous Drugs Ordinance (Cap. 134) defines cannabis to include the viable seeds of any plant of the genus Cannabis, so germinable seeds are themselves a dangerous drug — trafficking or import can attract life imprisonment and a HK$5 million fine, and cultivation carries up to 15 years. There is no statutory concept of hemp, and even low-THC hemp seed transshipments through Hong Kong require dangerous drugs permits, per a USDA FAS report. Only sterilized, non-viable hemp seeds in food escape control. Since 1 February 2023 CBD is also listed as a dangerous drug, confirming the territory's zero-tolerance posture toward the entire cannabis plant.
