Bermuda's Misuse of Drugs Act 1972 defines cannabis as 'any plant or part thereof' of the genus Cannabis, excluding only fibre from the stalk, so unlike the UK definition viable seeds are controlled. The Misuse of Drugs (Decriminalisation of Cannabis) Amendment Act 2017 removed criminal penalties for simple possession of 7 grams or less, but did not legalise purchase, supply, cultivation or import, and cannabis remains a prohibited import. Supplying cannabis, with or without payment, remains an offence, so both sale and gifting of viable seed are unlawful. The Cannabis Licensing Act 2022, which would have created a licensed cultivation and retail regime, was denied assent in September 2022 on UK instruction, and no hemp licensing framework is in force.
