Recreational marijuana is decriminalised in small quantities in Bermuda but not legalised at retail. The Misuse of Drugs (Decriminalisation of Cannabis) Amendment Act 2017 removed criminal liability for possession of seven grams or less of cannabis; the Misuse of Drugs Act 1972 continues to criminalise possession above that threshold, supply, cultivation, and importation. Possession over seven grams attracts up to five years' imprisonment on summary conviction and longer on indictment; trafficking penalties reach life imprisonment.
The Cannabis Licensing Act 2022, passed by the Bermuda Parliament to establish a licensed adult-use industry, was withheld assent by the Governor on instruction from the United Kingdom in September 2022 on the basis that it would breach the United Kingdom's obligations under the 1961 Single Convention on Narcotic Drugs. The status of the Act remains uncertain, and no licensed retail market has commenced. Enforcement is led by the Bermuda Police Service and HM Customs at L F Wade International Airport (BDA) and the Hamilton and Dockyard cruise ports.

Import and export of recreational cannabis remain prohibited. HM Customs Bermuda controls movements at L F Wade International Airport (BDA), the Royal Naval Dockyard cruise terminal, Hamilton harbour, and Saint George's. Even with a licensed regime contemplated by the Cannabis Licensing Act 2022, Royal Assent was withheld and no cross-border commercial cannabis trade is authorised. The decriminalisation threshold of seven grams applies only to possession within Bermuda, not to importation.
