The Illicit Drugs Control Act 2004 defines 'cultivate' to include planting, sowing and scattering seed of the cannabis plant, so dealing in viable marijuana seeds is prosecuted as an illicit-drug offence. The Illicit Drugs Control (Budget Amendment) Act 2022 (Act 41 of 2022) removed industrial hemp with THC not exceeding 1% from the illicit list, permitting its importation, possession, cultivation, sale and supply, but the Attorney-General confirmed growing requires a government licence and the Ministry of Agriculture's pilot remains embryonic. A 2024 Ministry of Trade feasibility study and 2025 Cabinet review of export-led medicinal cannabis have not yet changed the law on high-THC seeds.
