Decreto-Lei n.º 2-B/93 of 28 October 1993 punishes with 2 to 12 years' imprisonment anyone who without authorization cultivates, produces, offers, puts on sale, sells, distributes, buys, cedes (transfers gratuitously) or possesses plants or substances in Tables I-II (art. 3), and its Table I lists 'Cannabis e resina de cannabis' without the leaf-and-flowering-top limitation used in the Portuguese model, so whole-plant material including viable seed is captured. Article 5 separately criminalizes supplying materials known to be destined for illicit cultivation, and art. 20 penalizes even cultivation or acquisition for personal consumption. Seeds are not individually itemized in the annexed tables, but the cultivation and cession offences leave no lawful route for seed commerce or gifting, and no hemp distinction, THC threshold or licensing framework exists.
