Is CBD Legal in Bahamas?

CBD has no clean legal home in The Bahamas. The Cannabis Act, 2024 regulates cannabis with THC above 0.3% and routes medical access through licensed dispensaries under the Cannabis Authority, but it did not create a stand-alone category for CBD products or for hemp-derived cannabidiol. The Dangerous Drugs Act, dating to 1929 and broadened in 1962 to capture hemp and cannabis derivatives, still defines the controlled-substance perimeter.

The practical result is that CBD oils, isolates, tinctures, gummies, and topicals remain at legal risk regardless of THC content unless they move through the licensed medical channel. Customs officers can and do treat imported CBD as a prohibited cannabis product. There is no published THC ceiling for over-the-counter CBD wellness sales because no such retail category has been authorized. Buyers cannot rely on a 0.3% rule the way they would in the United States, and pharmacies do not stock CBD as a general-sale item. The Third Order under the Act sets reciprocity for foreign medical cannabis cards from 28 US states plus Canada and several other jurisdictions, which may give visiting patients a route in.
