Idaho Code § 37-2701 defines marijuana to include seeds, exempting only sterilized seed incapable of germination, and § 37-2732 criminalizes possession and delivery — Idaho has no medical or adult-use program. The statute creates an explicit presumption that any cannabis material possessed without a hemp license is marijuana. Viable hemp seed may be possessed and planted only by ISDA-licensed producers and handlers under the 2021 Industrial Hemp Act (HB 126), and Idaho separately requires finished hemp products to contain no measurable THC.
