The statute creates an explicit presumption that any cannabis material possessed without a hemp license is marijuana. Viable hemp seed may be possessed and planted only by ISDA-licensed producers and handlers under the 2021 Industrial Hemp Act (HB 126), and Idaho separately requires finished hemp products to contain no measurable THC.
