Under the Cannabis Regulation and Tax Act (410 ILCS 705), home cultivation of up to 5 plants is reserved for registered medical patients, who may purchase seeds only from a licensed Illinois dispensary; the state's Cannabis Regulation Oversight Office confirms seeds 'may not be given or sold to anyone else,' making gifting unlawful. Non-patient adults have no lawful acquisition path and cultivation by non-patients is a civil violation escalating to felonies (410 ILCS 705/10-5 limits adults to 30 g flower). Viable hemp seed may be cultivated only under an Illinois Department of Agriculture license per the Industrial Hemp Act, 505 ILCS 89.
