Since Measure 91 (now codified at ORS ch. 475C), Oregon adults 21+ may buy marijuana seeds from OLCC-licensed retailers — capped at 10 seeds per transaction under OLCC rules (OAR ch. 845 div. 25) — possess seeds without a stated limit, and grow four plants per household (ORS 475C.301). ORS 475C.337 permits delivery of seeds and immature plants to another adult without consideration, so gifting is expressly lawful, while unlicensed sales remain prohibited. Hemp seed is regulated by the Oregon Department of Agriculture under ORS ch. 571, which requires grower registration and use of tested seed.
