Restricted at hemp retail. Oregon applies a total-THC reading to hemp under ORS Chapter 571 and the Oregon Department of Agriculture's rules, which the Oregon Department of Agriculture put in place in 2019 and the Legislature reinforced through House Bill 3000 in 2021.

Is delta-8 THC legal in Oregon?

No at hemp retail. Oregon House Bill 3000 (2021) defined artificially derived cannabinoids, and OAR 845-025-1310 (December 2021) requires those cannabinoids to be Generally Recognized as Safe by the FDA or covered by a New Dietary Ingredient notification before they can be sold in the adult-use system.

Is hemp-derived delta-9 THC legal in Oregon?

Restricted at hemp retail. Oregon House Bill 3000 (2021) caps the total THC permitted in hemp items sold outside the Oregon Liquor and Cannabis Commission system and routes intoxicating delta-9 products into licensed dispensaries.

Since Measure 91 (now codified at ORS ch. 475C), Oregon adults 21+ may buy marijuana seeds from OLCC-licensed retailers — capped at 10 seeds per transaction under OLCC rules (OAR ch. 845 div. 25) — possess seeds without a stated limit, and grow four plants per household (ORS 475C.301). ORS 475C.337 permits delivery of seeds and immature plants to another adult without consideration, so gifting is expressly lawful, while unlicensed sales remain prohibited. Hemp seed is regulated by the Oregon Department of Agriculture under ORS ch. 571, which requires grower registration and use of tested seed.
