Law 10113 of 2022 legalized medical cannabis and industrial hemp (up to 1% THC), with cultivation and seed use confined to licensees authorized by the Ministry of Agriculture (MAG) and Ministry of Health; implementing regulations for the law were approved in February 2025 and dozens of hemp authorizations have since issued. Recreational cultivation remains punishable under narcotics Law 8204, and no statute expressly addresses private purchase, possession or gifting of viable cannabis seeds, leaving individuals outside the licensed system in a legal gray area.
