Republic Act No. 9165, the Comprehensive Dangerous Drugs Act of 2002, classifies marijuana as a dangerous drug and Section 16 punishes planting or cultivating it — conduct that necessarily covers germinating seeds — with life imprisonment and fines up to PHP 10 million. Possession of under 300 grams can bring twelve years to life, and medical intent is no defence. The Medical Cannabis Act (House Bill 10439) passed the House in February 2024, but its Senate counterpart remained at committee level as of early 2026, leaving no lawful channel for viable cannabis or hemp seed.
