Pennsylvania's Medical Marijuana Act (Act 16 of 2016) permits only processed forms dispensed by licensed dispensaries and grants no cultivation rights to patients, and adult-use legalization stalled when the Senate tabled HB 1200 in May 2025 (SB 76, the patient home-grow bill, also remained in committee into 2026). The Controlled Substance, Drug, Device and Cosmetic Act defines marihuana to include the plant's seeds (35 P.S. § 780-102), so selling, acquiring, or gifting viable marijuana seeds is possession or delivery of a Schedule I substance under § 780-113. Hemp seed is lawful for growers holding a Pennsylvania Department of Agriculture hemp permit under the state's hemp program.
