THCP

Where it is legal, restricted or banned in every US state we track, with the law behind each status and the latest news on changes.

Federal status

THCP occurs naturally in cannabis in trace amounts, but products on the market use THCP made by chemical synthesis or conversion, which the DEA treats as outside the 2018 Farm Bill's protection. Starting December 11, 2026, the federal hemp definition excludes cannabinoids synthesized outside the plant and counts cannabinoids with THC-like effects toward the 0.4 mg per-container cap.

Overview

What to know

THCP (tetrahydrocannabiphorol) is a THC analog first identified in cannabis in 2019. It has a longer side chain than delta-9 THC and is reported to be far more potent at the same cannabinoid receptors. Because the plant makes so little, commercial THCP is manufactured, usually in small amounts blended into vapes and gummies.

THCP has been sold under the same hemp theory as delta-8 and HHC. The DEA has said that tetrahydrocannabinols produced through chemical conversion are synthetic even when they start from hemp. A number of states name THCP in their bans on intoxicating hemp cannabinoids.

The federal hemp redefinition closes the remaining path. It excludes cannabinoids synthesized or manufactured outside the plant and caps THC and cannabinoids with similar effects at 0.4 mg per container. Those rules take effect December 11, 2026. Check your state's rules, which may already ban THCP.

FAQ

Common questions

Is THCP legal federally?

It has been sold as hemp, but the DEA considers conversion-made THCs synthetic. Starting December 11, 2026, THCP products will fall outside the federal hemp definition because commercial THCP is manufactured outside the plant.

Is THCP natural?

THCP has been found in cannabis, but only in trace amounts. The THCP in consumer products is made in a lab.

Will THCP be banned in November 2026?

For THCP, the federal change now takes effect December 11, 2026, when the synthesized-cannabinoid exclusion and 0.4 mg cap begin. November 12 still applies to cannabinoids the plant cannot naturally produce.
