The Misuse of Drugs Acts 1977–2016 define cannabis so as to exclude seeds separated from the rest of the plant, meaning possession, sale or gifting of ungerminated cannabis seeds is not an offence in Ireland. Germinating seeds amounts to unlawful cultivation of cannabis under section 17 of the 1977 Act unless the grower is licensed. Industrial hemp may be cultivated only under a licence processed by the Health Products Regulatory Authority (HPRA) on behalf of the Department of Health, using EU-approved low-THC varieties, and licence holders must destroy the leaf and flower.
