La. R.S. 40:961's marijuana definition covers seeds, and Louisiana's medical program permits no patient cultivation, so viable seed remains contraband; under HB 652 (2021) possession of under 14 grams — which would cover a seed packet — is decriminalized to a $100 fine, but it is still an offense rather than a legal right. Distribution, including gifting, and cultivation remain felonies punishable by up to 30 years for large amounts. Viable hemp seed may be obtained and planted only by growers licensed by the Louisiana Department of Agriculture and Forestry under R.S. 3:1461–1473, using department-approved seed sources.
