K.S.A. 21-5701 defines marijuana to include seeds of all Cannabis varieties, exempting only sterilized seed incapable of germination and industrial hemp, so selling, buying, or gifting viable marijuana seed violates K.S.A. 21-5705/21-5706 in one of the last states with neither a medical nor adult-use program. Viable hemp seed may be acquired and planted only by growers licensed by the Kansas Department of Agriculture under the Commercial Industrial Hemp Act, K.S.A. 2-3901 et seq.; 2025's SB 292 tightened hemp product rules without liberalizing seed access.
