Code ch. 3780, effective Dec. 2023) legalizes adult home cultivation of six plants (twelve per household) and expressly allows dispensaries to sell seeds and clones, though as of 2026 few licensed dispensaries stock them, so growers rely on seed swaps and out-of-state banks. The statute permits transferring up to six plants or seeds to another adult 21+ without remuneration if not publicly advertised, and S.B. 56 (effective March 2026) tightened other rules but left home-grow and gifting provisions intact. Online seed purchases currently rest on DEA's 2022 hemp-seed interpretation, which H.R. 5371 §781 supersedes on Nov. 12, 2026 by excluding viable seed of high-THC plants from the federal hemp definition. Hemp seed cultivation requires an Ohio Department of Agriculture license under ORC ch. 928.
